List of Heirs

At the initial probate meeting, the Probate clerk prepares a List of Heirs of the decedent based on the information given by the fiduciary. 

The fiduciary signs the List of Heirs under oath stating that diligent inquiries into the names, addresses and ages of heirs of the decedent have been made. 

The heirs-at-law are those persons who would inherit from the decedent if the decedent died without a will. These persons are determined pursuant to Virginia’s statutes of descents and distribution.  See Virginia Code §§64.2-200 to 64.2-206.

It is important to note that if new information is discovered after qualification, an amended List of Heirs must be filed with the Clerk’s Office.
