Conservator Administration Final Account

The final account of a fiduciary is subject to special scrutiny. First, the fiduciary must distribute all of the remaining assets of the conservatorship. The account must show a zero balance on hand. Second, any distributions to the ward or his estate must conform to any requirements by the court and to statutory authorization. A simple statement of facts attached to the final account can greatly assist in the review and approval of that account. Virginia Code § 64.2-2026 provides a conservator with authority to pay certain estate administration expenses and to make limited direct distributions to beneficiaries if a ward dies prior to the restoration of his capacity.
